TOWN BOARD MEETING

MONDAY, MARCH 8, 2010 - 7:30 PM

 

Meeting called to order by Supervisor Fornario followed by the Pledge of Allegiance and a moment of silence.

PRESENT:  Supervisor Fornario, Councilman Nielsen, Councilman Kirkpatrick,

                                Councilwoman Wells-Calhoun, Councilwoman Murphy                            

ALSO PRESENT:      J. Benjamin Gailey, Attorney for the Town

     Supervisor Fornario, presented an Award of Recognition for the accomplishment of Kacie Evans, a Girl Scout, who is the recipient of the Gold Star Award, this is the highest Girl Scout Award.  Supervisor Fornario noted that Kacie is the only Blooming Grove Resident to receive the Girl Scout Gold Star Award.  Part of her obtaining the Gold Star Award was for making a “Teen Section” at the Country Store.

     Supervisor Fornario thanked everyone for the help that everyone did due to the recent snow storm a lot of people should get recognition including people in the audience and the Highway Department, Police, Fire, Ambulance and neighbors helping neighbors.  

 

APPROVAL OF MINUTES – FEBRUARY 22, 2010 TOWN BOARD MEETING  AND MARCH 1, 2010 TOWN BOARD WORK SESSION

I, Councilwoman Murphy, move that the minutes of the February 22, 2010 Town Board Meeting and the March 1, 2010 Town Board Work Session, be accepted as presented.  Seconded by Councilman Nielsen.

PUBLIC COMMENTS ON AGENDA ITEMS

     Mary Wiley asked what the Silver Star Banner Day is.

     Supervisor Fornario noted Silver Star Banner Day is to recognize the accomplishments of returning service men and this is a non-profit organization.

     Mary Wiley wanted to know what the transfers of funds are to pay the bills.

     Supervisor Fornario noted that there are several checking accounts where money is transferred in to pay the appropriate bill.

 

SCHEDULE PUBLIC HEARING – INFRASTRUCTURE RECONSTRUCTION – WATER DISTRICT #5 MOUNTAIN VIEW

I,  Councilman Nielsen, move that authorization be given to schedule a public hearing on the infrastructure reconstruction in Water District #5 – Mountain View Estates for March 22, 2010,

at 7:30 PM.  Seconded by Councilman Kirkpatrick.

COMMUNITY DEVELOPMENT BLOCK GRANT  MONEY – F/Y 2010

I, Councilwoman Wells-Calhoun, move that authorization be given to the Supervisor to accept Community Development Block Grant Money F/Y 2010 for use at the Nutrition Site and for the Country Kids Food Pantry.  Seconded by Councilwoman Murphy.                  .

SILVER STAR  BANNER DAY PROCLAMATION   
WHEREAS, the Town of Blooming Grove has always honored the sacrifice of the men and women in the Armed Forces and

WHEREAS, The Silver Star Families of America was formed to make sure we remember the blood sacrifice of our wounded and ill by designing and manufacturing a Silver Star (Service) Banner and Flag and

WHEREAS, to date The Silver Star Families of America has freely given thousands of Silver Star (Service) Banners to the wounded and their families, and
WHEREAS, the members of The Silver Star Families of America have worked tirelessly to provide the wounded of this Town and Country with Silver Star (Service) Banners, Flags and care packages, and
WHEREAS, The Silver Star Families of America's sole mission is that every time someone sees a Silver Star (Service) Banner in a window or a Silver Star (Service) Flag flying, that people remember the (sacrificed) for this Town, State and Nation and
WHEREAS, the people and Town Board of Blooming Grove wish that the sacrifice of so many in our Armed Forces never be forgotten.
NOW THEREFORE, we, the Members of the Blooming Grove, New York Town Board do hereby proclaim our appreciation of The Silver Star Families of America and honor their commitment to our wounded Armed Forces members. We hereby declare May 1st “SILVER STAR BANNER DAY” the permanent and official day to honor the wounded and ill Soldiers of the Town of Blooming Grove.
This motion was put forth by Councilman Nielsen, seconded by Councilwoman Wells-Calhoun, 

and adopted by a vote of 5 Ayes and 0 Nays.

REFUND - $100 BUILDING PERMIT FEE – TANK REPLACEMENT

I, Councilman Nielsen, move that authorization be given for the refund of a $100.00 Building Permit Application Fee paid for a tank replacement, due to the fact that the tank did not have to be replaced..  Seconded by Councilman Kirkpatrick.

AWARD BID FOR SALE – (2) 1991  HIGHWAY TRUCKS.

I, Councilwoman Wells-Calhoun, move that authorization be given to award the bid for sale of two 1991 Highway trucks identified as 1991 International Vin# 1HTGEGBR1MH301102 Truck #5 and 1991 International Vin# 1HTGEGBRXMH301101- Truck #6 to Erik Johnson, Central Valley,  N. Y. at a bid of $1,860.00 for each truck in as is condition.  Seconded by Councilman Kirkpatrick.

AUTHORIZATION - REIMBURSE EXPENSES  - NYSTCA ANNUAL CONFERENCE

I, Councilwoman Murphy, move that authorization be given to reimburse the expenses for the Town       Clerk to attend the Annual New York State Town Clerks Association Conference being held in Saratoga, New York April 25-28, 2010 with the costs not to exceed $900.00.

Seconded by Councilman Nielsen.              .

WASHINGTONVILLE PAL – BASKETBALL COURTS – MAY’S FIELD

I, Councilwoman Wells-Calhoun, move that authorization be given to the Washingtonville PAL for use of the Basketball Courts at May’s Field Mondays and Wednesdays, July 5th through August 4th, 2010, evenings from 5:45 PM to 9:00 PM.     Seconded by Councilwoman Murphy. 

 Vote of the Board:  Councilwoman Murphy-Aye, Councilwoman Wells-Calhoun-Aye,  Councilman Kirkpatrick-Aye, Councilman Nielsen – Aye, Supervisor Fornario– Aye.

 

POLICE DEPARTMENT – AUTHORIZATION  TO SURPLUS –

KONICA MINOLTA COPIER, SERIAL #31113804

I, Councilman Nielsen, move that authorization be given to the Police Department to surplus one (1) Konica Minolta Copier, Serial #31113804.   Seconded by Councilwoman Murphy.

TRANSFER OF FUNDS

I, Councilman Nielsen, move that authorization be given to transfer funds to the checking accounts necessary to pay the warrants.  Seconded by Councilwoman Murphy.                  

   Vote of the Board:  Councilwoman Murphy-Aye, Councilwoman Wells-Calhoun-Aye,  Councilman Kirkpatrick-Aye, Councilman Nielsen – Aye, Supervisor Fornario– Aye.

 

WARRANTS

I, Councilman Nielsen, move that the bills of the Town be paid as audited by the Town Comptroller and approved by the Town Board.  Seconded by Councilwoman Murphy.            

   Vote of the Board:  Councilwoman Murphy-Aye, Councilwoman Wells-Calhoun-Aye,  Councilman Kirkpatrick-Abstain, Councilman Nielsen – Aye, Supervisor Fornario– Aye.

 

PUBLIC COMMENTS –

The following matters were discussed during the public comments portion of the meeting:

     Mike Getz noted the Highway Department did a good job with the storm.  He also voiced concerns, there is a condemned house on the trail part of the roof caved in and part of the house falling in and asked the Board to contact O&R to have the power turned off and there is an abandoned car blocking the road that needs to be towed.

     Mary Wiley also noted the good job the Highway Department did with the storm, she also noted the baseball fields trimming outside the fence was done by the Village and should continue to be done by the Village.  She also stated the stray cats should be caught and have them fixed or killed many spreading diseases and rabies and are making well animals sick.

     Councilman Nielsen noted there are coyote sightings in the area and people putting out food.

     Peggy Lockwood thanked the Highway Department for a good job – a power line was down and can the Town contract with O&R to plow the roads.

     Jean Palkovitz noted that since the last meeting she spoke with the Police Chief and she had misunderstood the number of calls she also added the Highway Department did a good job with the storm and the Police did a good job to help get through the storm with an emergency.

     Kate Amati handed information to the Board and attendees regarding Schunnemunk State Park, Minnewaska State Park urging everyone to express their concerns to keep these open.

     Supervisor Fornario noted there is a Water Master Plan Meeting taking place March 10th, 2010, asked everyone to attend to show concerns.

     Jennifer Vieira noted that the Town is buying a paver and there are potholes on Barnes Road between 208 and Barnes.

PUBLIC COMMENTS – CONTINUED

      Supervisor Fornario noted there is an opening for the Board of Assessment Review and an ad was placed in the Orange County Post.  Anyone interested should send in a letter of interest.  There will also be water and sewer meetings starting April 21st with Tomahawk Lake, April 27th Oxford, April 29th Mt. View and May 5th Tappan Hill.  There will be a joint meeting with the Village Mayors  and himself.     MOUNTCO has final scoping document and it is on line.  April 17th is Clean-Up Day.

     Richard Bachman requested a note be put in the water and sewer bills to make people aware of the meetings.

   Supervisor Fornario noted there will be a letter and also on web site.
